Terms of Service & Client Service Agreement

These Terms of Service (“Agreement”) govern all cybersecurity consulting services, including but not limited to vulnerability assessments, mobile device hardening, and cybersecurity awareness training (collectively, the “Services”), provided by Enkairos LLC (“Enkairos,” “we,” “us,” or “our”) to any individual, household, non-profit, or business that books or receives Services (“Client,” “you,” or “your”). By booking an appointment, requesting a consultation, or otherwise engaging Enkairos for Services, you agree to be bound by this Agreement.
1. Authorization to Access and Test Systems
Our Services require Enkairos to access, examine, configure, or test devices, accounts, networks, or systems that you own, control, or are otherwise authorized to grant access to (collectively, “Systems”). By engaging Enkairos, you represent and confirm that:
- You own the Systems in question, or you have obtained all necessary permission from the owner(s) to authorize Enkairos to access and test them;
- You are granting Enkairos explicit, written authorization to access, assess, configure, and/or harden the specific Systems agreed upon for the engagement; and
- You will clearly communicate the scope of authorized Systems to Enkairos before work begins, and Enkairos will not knowingly access Systems outside that agreed scope.
This authorization is a required condition of service. Enkairos will not perform testing, scanning, or configuration changes on any System without your prior consent.
2. Nature of Services and Assumption of Risk
Cybersecurity assessments and device hardening involve inherent risk. Actions such as scanning a network, changing device settings, disabling features, or applying security patches can, in rare cases, cause a device or service to behave unexpectedly, become temporarily unavailable, or reveal a pre-existing issue unrelated to our work. You acknowledge and accept this risk as a normal part of engaging cybersecurity services.
We strongly recommend backing up important data before any appointment. Enkairos is not responsible for data loss resulting from a Client’s failure to maintain adequate backups.
3. Limitation of Liability
To the fullest extent permitted by law, Enkairos LLC’s total liability arising out of or related to the Services shall not exceed the total amount paid by the Client for the specific engagement giving rise to the claim. Enkairos shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to lost profits, lost data, or business interruption, even if advised of the possibility of such damages.
Enkairos does not guarantee that any System will be completely secure or free of vulnerabilities following our Services. Cybersecurity is an ongoing process, and no assessment or hardening service can eliminate all risk.
4. Confidentiality
Enkairos will treat all information obtained during an engagement, including any vulnerabilities discovered, as confidential. We will not disclose findings about your Systems to any third party without your written consent, except where required by law.
5. Client Responsibilities
- Provide accurate information about the Systems to be assessed or serviced;
- Ensure you have the legal right to authorize testing on all Systems provided for service;
- Back up important data prior to your appointment;
- Be available (in person or by phone) during the scheduled appointment window to grant access and answer questions as needed.
6. Cancellations and Rescheduling
Please provide as much notice as possible if you need to cancel or reschedule an appointment, using the booking confirmation sent to you. Repeated late cancellations may affect future scheduling availability.
7. Governing Law
This Agreement shall be governed by the laws of the State of Washington, without regard to its conflict of law provisions.
8. Communications Consent (SMS & Phone Calls)
By providing a phone number to Enkairos LLC—through our online booking system, a service request, or direct communication—you consent to receive phone calls and text messages (SMS) from our business number regarding appointment confirmations, reminders, rescheduling, and other service-related communications. We do not use your phone number for marketing calls or texts unless you separately opt in. Message and data rates may apply, and you may opt out of text messages at any time by replying STOP. Consent to receive calls or texts is not a condition of purchasing any Services. See our Privacy Policy for full details.
9. Acceptance
By booking an appointment through our website, checking the agreement box at checkout, or otherwise engaging Enkairos LLC for Services, you confirm that you have read, understood, and agree to this Terms of Service & Client Service Agreement.
